Terms of Use

These terms explain the rules for using peakpals.am: reading the Journal, joining the waitlist and contacting us. They are written to be read, not skimmed past.

1. Agreement

peakpals.am is operated by PeakPals, a clothing label based in Noida and New Delhi, India (“PeakPals”, “we”, “us”). By using the site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

2. What the site is

peakpals.am introduces PeakPals, publishes the Journal and runs a waitlist for the first collection. The site is free to use. No products are sold on the site today. When shopping opens, separate terms of sale covering pricing, payment, shipping, returns and refunds will apply to purchases, in line with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

3. Who can use it

You must be at least 18 years old to join the waitlist or contact us, or have the involvement of a parent or guardian. By submitting a form, you confirm that the details you give are your own and accurate.

4. The waitlist

• Joining the waitlist is free and creates no obligation to buy anything.
• A place on the waitlist does not guarantee an invitation, a product, a price or a launch date. Invitations are sent at our discretion and may open city by city.
• Your position number is indicative, not a promise of order.
• We may remove sign-ups that appear fake, duplicated or automated.
• You can leave the waitlist at any time by emailing raghav@peakpals.in.

5. Acceptable use

When using peakpals.am, you agree not to:

• Use the site for anything unlawful, or to impersonate anyone.
• Submit forms in bulk or by automated means, or send spam, abusive or harmful content through the contact form.
• Scrape, copy or harvest content or data from the site by automated means, beyond normal search-engine indexing.
• Try to gain unauthorised access to the site, its admin area or its data, test its security, or disrupt it, including by introducing malicious code.

We may block access, delete submissions and take legal action against misuse.

6. What you send us

Messages, ideas and feedback you send stay yours. By sending them, you allow us to read, store and use them to reply to you and to improve PeakPals, without any obligation to pay or credit you. Please do not send anything confidential.

7. Our intellectual property

The PeakPals and PEAKPALS.AM names, logos, the line “Be At Peak With Pals”, product designs, photographs, videos, Journal articles and the design and code of the site belong to PeakPals or its licensors. You may read and share links to our pages for personal, non-commercial purposes and quote short excerpts with credit and a link back. Any other use, including commercial use or reproducing our designs, needs our written permission.

8. Information on the site

Journal articles and product information are for general information. Wellness and fabric content is not medical advice. Because PeakPals is in pre-launch, designs, materials, colours and plans described on the site may change before launch.

9. Links to other sites

The site links to services such as Instagram and LinkedIn. We do not control those services, and their own terms and privacy policies apply when you use them.

10. Availability

We work to keep peakpals.am available and accurate, but we provide it free of charge and on a best-effort basis. We may change, suspend or discontinue any part of the site at any time.

11. Disclaimer

The site is provided “as is” and “as available”. To the extent permitted by law, we make no warranties, express or implied, that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.

12. Limitation of liability

To the extent permitted by law, PeakPals is not liable for any indirect, incidental, special or consequential loss arising from your use of the site, and our total liability to you for any claim relating to the site is limited to ₹1,000. Nothing in these Terms limits any liability that cannot be limited under applicable law, or your rights as a consumer under the Consumer Protection Act, 2019.

13. Indemnity

You agree to compensate PeakPals for losses and reasonable legal costs arising from your breach of these Terms or your misuse of the site.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to your right to approach a consumer commission under the Consumer Protection Act, 2019, the courts at Gautam Buddh Nagar (Noida), Uttar Pradesh, have exclusive jurisdiction over any dispute relating to the site or these Terms. Before going to court, please write to us so we can try to resolve the issue informally.

15. Changes to these Terms

We may update these Terms, for example when shopping opens. Changes take effect when posted here with a new “Last updated” date. If you keep using the site after that, you accept the updated Terms.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Not enforcing a term straight away does not waive our right to do so later. These Terms and the Privacy Policy are the whole agreement between you and us about the site.

17. Contact and grievances

Questions about these Terms, copyright or trademark complaints, and grievances under the Information Technology Act, 2000 go to Raghav Budhraja, Founder, at raghav@peakpals.in. We aim to acknowledge complaints within 48 hours and to resolve them within 30 days.
